- Post listings for home gym equipment;
- Upload photographs and written descriptions of items you list for sale;

- Submit offers on items listed by other users;
- Provide reviews or other comments;
- Request customer support or otherwise communicate with us.

- Your name;
- Email address;
- Account password (stored in encrypted form);
- Postal code or ZIP code;
- Photographs you upload of items you post for sale;
- Written descriptions of your posted items;
- Offers you make on items;
- Reviews or comments you make on the Services;
- Messages with other users sent through the Services;
- Any other information you choose to provide.
B. Information We Collect Automatically
When you access or use the Services, we automatically collect information about you, including:
- Log and usage data: We log information about your use of the Services, including the type of browser you use, access times, pages viewed, your IP address, and the page you visited before navigating to our Services.
- Device information: We collect information about the computer or mobile device you use to access the Services, including the hardware model, operating system and version, and unique device identifiers.

- Personalize the Services, including optimizing the location and type of listings presented to you;
- Facilitate transactions and communications between buyers and sellers;
- Create and maintain a trusted and safer environment on the Services, including through detection and prevention of fraud, unauthorized access, and other harmful activity;
- Conduct investigations and respond to disputes between users, error resolution, and other customer support services;
- Operate, protect, improve, and optimize the Services, our business, and our users' experience;
- Perform analytics, conduct research, and monitor and analyze trends, usage, and activities in connection with the Services;
- Communicate with you about products, services, offers, and events related to the Services;
- Send you service, support, and administrative messages, reminders, technical notices, updates, security alerts, and information requested by you;

Data Processing Location
Home Gym Marketplace is based in the United States and the information we collect is governed by U.S. law. By accessing or using the Services or otherwise providing information to us, you consent to the processing and transfer of information in and to the United States, where you may not have the same rights and protections as you do under local law.

A. Disclosure for Business Purposes
We may disclose information about you:
- With the public when you post listings, reviews, or other content on the Services. Information included in your public profile and listings is visible to other users and the general public.
- With other users when you interact with them through the Services, including when you send messages, submit offers, or complete transactions.
- With service providers who need access to such information to carry out work on our behalf, including web hosting, email delivery, analytics, customer service, and infrastructure providers.
- In response to legal process if we believe disclosure is in accordance with any applicable law, regulation, or legal process, or as otherwise required by any applicable law, rule, or regulation.
- To protect rights and safety if we believe your actions are inconsistent with our user agreements or policies, if we believe you have violated the law, or to protect the rights, property, and safety of Home Gym Marketplace or others.
- In connection with a business transfer during negotiations of, or in connection with, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.
- With your consent or at your direction, including if we notify you through the Services that the information you provide will be shared in a particular manner and you provide such information.
We may also share aggregated or de-identified information, which cannot reasonably be used to identify you. We maintain and use this information only in a de-identified fashion and will not attempt to re-identify such information, except as permitted by law.
B. Information You Make Public
When you create a listing, certain information is made publicly available, including the item description, photographs, asking price, your display name, and your general location (city or area). When you interact with other users through the Services, those users may see your profile information and messaging activity. You should consider what information you share publicly or with other users.
C. Security
Home Gym Marketplace takes reasonable measures to help protect information about you from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction. We limit the sharing of personally identifiable data with third parties and, where identifiable data must be shared, we take steps to ensure that those parties provide appropriate protections.
IV. Your Choices
A. Account Information
- You may update, correct, or remove account profile information at any time by logging into your account and editing your profile.
- You may delete your account directly from your account settings within the app. If you need assistance, you can also contact us at admin@homegymmarketplace.com and we will initiate the deletion process on your behalf.
- We may retain certain information as required by law or for legitimate business purposes. Certain information such as reviews and other content posted by you may continue to be publicly available (but not associated with your personal information) on the Services after your account is deleted.
B. Location Information
Location-based features on the Services use the ZIP code or postal code you provide and may also use your IP address to infer an approximate location. Even if you do not provide a ZIP code, we may use your IP address to infer an approximate location for certain features.
C. Cookies and Tracking Technologies
Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser cookies. Please note that removing or rejecting certain cookies may affect the functionality of the Services, including your ability to remain logged in.
We use only the cookies described below. We do not use third-party advertising or marketing cookies, and we do not allow third parties to set cookies through the Services for cross-context behavioral advertising.
Strictly necessary cookies — used to keep you signed in, maintain your session, verify password-reset links, and gate access to our pre-launch site. Blocking these will prevent you from staying logged in or completing core flows on the Services.
Functional cookies — remember preferences such as your last-used browse location and which notices you've already dismissed, so we don't re-prompt you on every visit. Blocking these will not break the Services, but you may see repeated prompts or have to re-enter preferences each visit.
Non-cookie tracking technology. We use Vercel Web Analytics to measure aggregate page views. Vercel Web Analytics is cookieless: it does not set cookies on your device and uses a daily-rotating, in-memory anonymous identifier that cannot be tied back to you. We do not share this data with third parties for advertising.
First-party event analytics. On our event pages (such as our HomeGymCon vendor floor), we record anonymous, aggregate usage — which event pages and vendor booths are viewed, and what attendees search for — using our own browser-storage identifiers, not third-party trackers or advertising cookies. This data is device-level and anonymous: it contains no name, email, or contact information, and it is never sold or shared with third parties for advertising. We honor the Global Privacy Control (GPC) signal for this analytics: if your browser sends GPC, we do not record these behavioral-analytics events. See Your Privacy Choices below.
D. Promotional Communications
You may opt out of receiving promotional emails from Home Gym Marketplace by following the unsubscribe instructions in those communications. Even if you opt out of promotional communications, we may still send you transactional messages, such as those related to your account, your transactions, or security alerts.
E. State-Specific Privacy Rights
Some U.S. states have enacted consumer privacy laws that grant their residents certain additional rights regarding personal information. If you are a resident of such a state (including California, Colorado, Connecticut, Virginia, or other states with applicable privacy laws), you may have the right to:
- Request access to the personal information we have collected about you;
- Request deletion of your personal information;
- Request correction of inaccurate personal information;
- Opt out of the sale or sharing of your personal information (note: Home Gym Marketplace does not sell your personal information to third parties); and
- Not be discriminated against for exercising your privacy rights.

F. Your Privacy Choices
This section summarizes the choices you have about how we handle your information. It complements, and does not replace, the formal rights described in State-Specific Privacy Rights above.
Global Privacy Control (GPC). If your browser sends the Global Privacy Control signal, we treat it as an opt-out of the sale or sharing of your personal information under the California Consumer Privacy Act (CCPA/CPRA). We do not currently sell or share your personal information for cross-context behavioral advertising, so this signal does not change our core practices today. As a good-faith gesture, when we detect the signal we also suppress our first-party page-view analytics for your browser, and any future third-party analytics or advertising integrations we add will honor it.
Cookie controls. You can clear or block cookies through your browser settings at any time. Most browsers also let you control cookies on a per-site basis. Note that blocking strictly necessary cookies (such as our sign-in cookies) will prevent you from staying logged in. See Cookies and Tracking Technologies above for the full list of cookies we set.
Other privacy requests. To request access, deletion, or correction of your information, or to exercise any of the state-specific rights described above, email admin@homegymmarketplace.com.
V. Data Security
We use reasonable administrative, technical, and physical safeguards to protect the information we collect and maintain. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee the absolute security of your information. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.
VI. Data Retention
We retain your personal information for as long as your account is active or as needed to provide the Services. We may also retain and use your information as necessary to comply with our legal obligations, resolve disputes, prevent fraud, and enforce our agreements. When your account is deleted, we will remove or de-identify your personal information within a reasonable time, except as required by law or for legitimate business purposes.
VII. Children's Privacy
The Services are not directed to individuals under the age of 18, and we do not knowingly collect personal information from children under 18. If we learn that we have collected personal information from a child under 18, we will take steps to delete that information as promptly as possible.
